Pre-marital Agreements

A Pre-Marital Agreement (sometimes referred to as a pre-nuptial agreement) is an agreement reached between two people who wish to marry and who want to organise their legal position if they subsequently divorce.

Pre-Marital Agreements, in addition to giving personal security, can also help smooth separation and divorce, reducing the stress should the marriage come to an end. It is crucial to a Pre-Marital Agreement that both parties are legally represented and that neither party is under any pressure to agree to the terms. Additionally, there should be complete disclosure to each other of the parties’ financial position.

Pre-Marital Agreements are not legally binding in the UK; however, they are increasingly influential in terms of assessing the division of income and assets on divorce and, if prepared properly, can hold weight in any future divorce and ancillary relief proceedings.
