Civil Mediation

Although we have a wealth of Court and Tribunal experience, we understand the importance of exploring alternatives to litigation.  A primary and popular form of Alternative Dispute Resolution is Mediation, which can be much quicker, less stressful and cheaper than going to court.

Ben Barber is head of our Dispute Resolution Team and an Accredited Mediator with the London School of Mediation.  He is a keen and enthusiastic mediator.

Mediation is:

A completely voluntary and completely confidential form of alternative dispute resolution.  

It involves an independent, impartial person helping two or more individuals or groups reach a solution that's acceptable to everyone. 

The mediator can talk to both sides separately or together to understands all sides of any problem. 

Mediators are not engaged to make judgments or decide on matters - they ask questions and assist parties in understanding issues.  A good mediator will help a party clarify their objectives and identify the important issues in resolving a difference or dispute.

It is a confidential process and the nature of the discussions are not disclosed to anyone but those involved in the meeting.
All sides share the costs of the mediation, which can vary depending on the complexity and value of the claim.  

Workplace Mediation:

No matter how well run or organized your business, a dispute between employees or between employees and you as an employer can quickly arise.

Mediation can be used to help restore and maintain an employment relationship that has broken or is breaking down.   It can be used to help focus on working together to go forward, not identifying blame. 

Importantly for your business it can have fewer costs, offer less disruption to management time and often allow better solutions than litigation.
